Hanwha Q Cells fails with appeal in US patent case against Jinko

The US Court of Appeals for the Federal Circuit has agreed with the conclusion of the International Trade Commission (ITC) that the products of JinkoSolar Holding Co Ltd (NYSE:JKS) do not infringe a patent asserted by Hanwha Q Cells.

As previously announced, the Korean company launched an ITC investigation in March 2019 against JinkoSolar and two other competitors, namely Longi Solar of China and REC Group of Norway, claiming that they infringe its US Patent 9,893,215.

The ITC unveiled its final determination in June 2020 through which it dismissed the claim, leading to Hanwha Q Cells appealing the rulling. Now, a three-judge panel from the Federal Circuit has “agreed decisively” with the ITC.

"Cases like these are a transparent attempt to disrupt business, but we remain steadfast in our commitment to innovation and product leadership,” commented Xiande Li, Chairman and CEO of JinkoSolar.

Earlier this month, Hanwha Q Cells also saw another one of its patents in the US be invalidated, as reported by Longi Solar.
