SMA Solar, Sungrow settle out of court patent infringement case

Jun 10, 2014 - German solar inverter maker SMA Solar AG (ETR:S92) said on Friday it has reached an out-of-court settlement with the German unit of Chinese firm Sungrow Power Supply Co (SHE:300274) on a patent infringement case.

Sungrow Deutschland GmbH agreed to pay the licence fees for the past and future use of SMA Solar's patent-protected technology. In return, SMA will withdraw the patent infringement suit while Sungrow takes out its application for the annulment of the patent.

Both companies will bear their respective legal costs. SMA Solar said it is pleased with the mutual agreement as it will lead to legal certainty.

SMA started legal action against Sungrow Deutschland in June 2013 in Germany to stop it from alleged violations of SMA patents and asked for damages.
