Maxeon Solar Technologies Ltd (NASDAQ:MAXN) on Wednesday announced it is filing a new patent infringement lawsuit in Germany against European units and partners of Shanghai Aiko Solar Energy Co Ltd (SHA:600732), and is appealing the preliminary ruling of a Dutch court in an ongoing case.

More specifically, the Singapore-based photovoltaic (PV) panels maker is suing Aiko Energy Germany GmbH, Solarlab Aiko Europe GmbH, Aiko Energy Netherlands BV, and a number of existing European partners, including Memodo, Libra, VDH, PowerDeal, and Coenergia. This case was initiated in the Düsseldorf Local Division of the Court of First Instance of Unified Patent Court. According to Maxeon, each of these entities has infringed on a patent relating to solar cell technology.

At the same time, Maxeon is appealing the preliminary injunction decision from May 16 in the Netherlands in its ongoing patent action against Aiko.

"As part of our rigorous defense of Maxeon's intellectual property, today we announced that we are both appealing the decision in the Netherlands regarding the enforcement of our European Patent No. EP 2 297 788 B1 and filing a new action in UPC to enforce our recently granted European Patent No. EP 3 065 184 B1," said Marc Robinson, Maxeon's Associate General Counsel.

Robinson went on to say that Maxeon is looking for an injunction against Aiko and its distributors Memodo, Libra, VDH, PowerDeal, and Coenergia in each of the contracting member states, including Belgium, France, Germany, Italy, and the Netherlands.
